CS Replies: The Advertisement for outside recuitment is done for the available vacancy against outside quota only. There is no necessity to mention about departmental quota or the recruitment policy of JTO in the ad.

Query 436: Sir, why did our assn play with the 1966 SDE posts created in 1998. Had these posts filled as per the rules ( ie 1996 rules), then no one might have gone to courts and thus these posts would not have reverted. Now we 1994 JTO are not getting SDE promotion because these posts were abolished. Again what I understand from my senoirs that the modified seniority list is as per rule 206 which was removed by Supreme Court. Query 424: It is clear from the above that all the above direct recruit JTOs were later recruited through competitive examination ,trained in later batches and appointed later than me. All these JTOs shown appointed against year of recruitment-1993 whereas I have been shown as recruited for –1994,where in fact the advertisement reflects the backlog vacancies upto year –1989. Moreover I had applied against first advertisement as year of recruitment –1993. Sir, as we know the gradation list for JTO’s is prepared as per the year of recruitment and which is thebase of further promotion in the department. Now as these JTO’s were shown against the recruitment year 1993, all appears senior to me in the circle and All India gradation list, though recruited ,examined & appointed later than me. So likely they have got all the promotions though they are very junior to me in the department. This shows injustice with me. But in my case MTNL Mumbai ,an unit MH CIRCLE have not followed the sequence of allotment of recruitment year & not according to the relevant rules. Moreover it is made crystal clear by recent Judgement from Hon.Central Administrative Tribunal Mumbai that the candidates recruited through subsequent examination will have to be junior to those recruited earlier. It is specifically clear in my case that allotment of year of recruitment is not in conformity with the examination. It is well aware fact that earlier examined JTO should get earlier recruitment year than those recruited later. But I have been allotted year of recruitment – 1994 instead of 1993. Query 413: Dear sir, I joined in the department in 1992-feb in Tamilnadu. I have been transferred as officiating SDE to Bhavnagar in July 2004. Initially I was given with SDE (E) pay scale upto september - 05, later one circular was issued from HRD stating that during officiating period no monitory benefit to be given, deleting the relevant FR rules. so at I am getting JTO scale though I am working as SDE. Now I am going to complete 15years of service in couple of months. Still I am not getting pay benefit and I am being treated at par all other JTOs (E) throughout the country. Why is this partiality?. I already representated to Sr DDG (E) in this regard. No action taken so far. Now I want to go back to tamil nadu as a JTO (E). But as per the officiating orders, incase of reversion I have to continue in the present station only. Hoe can this be justified. CS Replies: SNEA has not supported for continuation of deputation, but to pave the way for smooth absorption of ITS. As I have already replied two similar queries, let me repeat that this action of GS was under a peculiar situation created by some unions and Federations. However, this is not going to give any mileage to ITSA. The ITS Mgt is trying to separate the GE-JTOs from the mainstream by formulating discriminatory policy in the name of TBP. You must be aware that SNEA has already taken up the issue. Formation of a separate Association by GE-JTOs is not advisable. Because "United we stand, divided we fall".

Query 401: Local officiating Language Officers i.e. ADOL/Rajbhasha Adhikari working in fields unit at SSA level are compelled to appear for Deptl limited comp.exam in fothcomming Dec/January 06 all over India at Circle level since this is cirlce post. But our senior ADOL are relctutant to appear for exam since they have denied their right senerioty cum fitness quota. There is no such quota in new RR of Rajbhasha Adhikar posts 2005. However, GS was perhaps under pressure from the Non-executive Unions and Federations as they threatened to go for a nationwide strike in support of the ITS officers. CS Replies: TBP policy itself is not desirable at its present form (financial upgradation only on fulfilment of attendant conditions) which has been put on hold. Moreover, the attendant conditions have also been incorporataed by the ITS management in case of regular promotions also. The condition of promotion, as of now, has become worse than the earlier one. SNEA is thoroughly worried for this. After failure of the last agitation program due to lack of desired support from most of the circles, Association is looking for more effective ways to resolve the issues.

Query 371: Sir, My husband is working as JTO in Himachal Pradesh and I am in Kerala.Both of us belong to the 2001 recruited GE JTOs.Initially there were 6 others along with my husband in HP circle.Now he is alone.Just within one year all the lady JTOs (they were 4 in no)got transfer to Kerala.And in 2004 the remaining two JTOs also got transfer.Eventhough my husband submitted request for transfer,it was rejected.I don^t know why he is the only person left there without any humanitarian consideration.There his life is horrible.Already his physical state is too bad.Now he is mentally week for being destined to be left alone while all the others from kerala joined along with him were able to enjoy some kind of special consideration somehow to get transfer to Kerala.I am working in Kerala itself because my rank in the entrance exam was within 700.The rank of all Kerala JTOs posted in HP (including my husband^s) is between 2000 and 3000. So is it have any logic to say that our problem can be solved if I am going to HP circle.Actually this was the commend of one of my husband^s senior officers when he applied for transfer to Kerala stating that his wife is working in BSNL Kerala.The comment was #His wife can come to HP circle and thus their problem can be solved. ha ha#. Ok we know that we have to work anywhere in India.But is this not applicable to all the JTOs?Why some people can get transfer within say 1yrs ,2yrs to places near to their houses.If a rule is there, should it be applicable to all the JTOs?Why my husband ,eventhough he is having much problems,alone is under a rule.Why he alone is destined to work 3000 kms away from his family.And why we,eventhough we work for the same company,get the most unfortunate treatment. Query 364: Dear Comrade, I hv transferred from Malda to Kolkata in the month of April^05, but Composite transfer grant was given to me @ old CDA basic only whereas in other SSA including my old SSA is giving IDA basic pay(one month basic pay) whereas Kolkata-SSA is giving only old CDA basic pay. though in Swamy^s TA rules it is clear that the Composite transfer grant comprising of one month basic pay plus 50% of DA, but they denies on the plea that there is no such orders from BSNL H.Q. Dear comrade , is there any order regarding composite transfer grant from BSNL HQ ? Query 357: Respected Sir, I hail from M.Chidambaram Pillai Illam, Thirruppararithurai, Tamil Nadu-639 115(Tele No- 0431-2614207). My husband is serving our mother land as an Air Warrior. At present he is posted in Air Force Station, Mohanbari, Dibrugarh-district, Assam. As we are staying far away from our family, we desired to take telephone connection to have communication with our aged parents. After a long struggle! (Yes, for taking telephone connection we struggled like anything). I got my land line telephone connection in Air force station Mohanbari House. The telephone no is 0373-2382906. After taking the telephone connection only we came to know that we have done a great mistake. Because instead of helping us, the telephone connection started giving disturbance. As because, at least in a month 10-15 days it will go un-serviceable. I have to request my husband to run for this. Here there is no proper compliant procedure. In our place (Mohanbari) we have nearly seventy five telephone connection, in this always nearly 15-25 telephone will be in unserviceable condition. I know many people whose telephone was unserviceable for more than 30 days also. If we ask anything to the authority they use to tell this is Assam, not your Tamil Nadu/ South, it will be like this only. They tell problems like Rain, Line man not available, cable missing/stolen and etc. I tried in all level from Local line man to GM Dibrugarh. But everything goes in vain, the problem persist. If you want, you go and complaint any where things will not change, this is the answer I always get from local level. Even two times I disturbed! GM telephone - Dibrugarh (0373-2320160, 2325080 & 2305081) and DE telephone - Dibrugarh many times (0373-2323999 & 9435000373) to rectify my telephone after failed in local level. Always I used to try with SDO telephone - Dibrugarh (0373-2325124 ) and Mohanbari exchange complaint cell (0373-2382598, & 2382599 ) to rectify my telephone connection. Even now also from past 20 days my telephone is un serviceable. Sir I request you to consider my problem is the problem of Mohanbari- Assam people^s Problem and do the needful things immediately for the permanent solution. Thank you in anticipation. Also uniform promotion policy be stressed that too after the absorption process of the ITS officers is over. CS Replies: You are correct. However, court case may not yield any positive result. We should pressurise the management after the issue of absorption of Grp A is over. Moreover, to pressurise we need strength, but unfortunately circles like UP, Bihar, MP, Maharastra, and almost all North Indian circle organizations of both SNEA and AIBSNLEA are too weak to fight for our demands. Take part in the Association actively, take the leadership and fight for our legitimate right.

Query 354: Trained TTAs are getting officiating promotion as JTOs in kerala. They are non-executives and discharging duties as executives.this practice is objectionable.as training is not a factor for officiating to higher post management can give officiating to a non-executive to executive post .this will surely decay the executive structure bsnl management is playing in tune with the powerfil non-executive union and diluting the jto post .
