Query 294: Dear Sir, What new is coming that BSNL Mgmt willing to recruit Mgmt trainees.But this should be only at entry level JTO. In other PSUs even if they recruit Mgmt trainee,that is only entry level as executive who then get promoted to Mgmt posts. But why this to happen in bsnl. IS JTO & Mgmt trainee different? This will harm future prospects of Graduate Engineers & also will demotivate us. SNEA should take 1st priority to stop any entry at middle level along with TB policy. CS Replies: We have already implemented the option in our circle through tireless efforts of SNEA. It is quite justified and as per the existing Govt. rule in this regard.

Query 291: Dear Sir, I am a direct recruit JTO joined BSNL Chennai Telephones on 24 Feb 2003 and completed phase one training on 2 June 2003 .My 2nd phase training is due. Since the 2nd increment can only be given after 2nd phase training for which our circle has not issued any orders. In spite of continuous reminders till date nothing has been done to ensure that we get 2nd phase training before completion of 2 years. This is in reference to those JTOs for 5ESS 2nd phase training. Query 272: Comrade CS heavy congestion of traffic in Assam region found due to new cellOne connections. From my point of view it is happening due to large no of calls from cell to landlines and vice versa. During these calls one has to enter the fixed line called exchange through their TAX PCMS. But without providing sufficient new TAX PCMS lot of BTS has been installed and new cell connections provided. Query 268: Dear Sir, I am Direct recruited JTO in Kalyan,Maharashtra. As per circle office, field training was completed on 28.03.2002.But the letter was not received by Admn. section in Kalyan. We 4 JTOs here collected the same elsewhere & given to Admn. section. Since 29,30,31 was holidays, we were able to receive letter on 01.04.2002. Our other batch mates were considered to as JTO from 29.03.02 although 29,30,31 were holidays. They also recd salary of the 3 days. We were new & there was nothing known to us what to do. Now we came to know that this may cause loss of seniority in the batch/recrtt.yr. Pls suggest the way what we should do to avoid the loss of seniority. Thanks. CS Replies: TBP and upgradation are not linked, though they yield identical results irrespective of time period involved. SNEA(I) is trying its best to see that all those included in the Eligibility List are promoted. TBP is not post based, but time based. It is promotion with all the benefits that one can expect on promotion.

CS Replies: JTO is a circle cadre and the seniority is maintained within a circle. Change of circle will naturally place one at the bottom of the gradation list in the new circle. However, this rule may not last long in BSNL, once JTO is declared as an All India Cadre. Till such time the existing rule is quite logical.

CS Replies: Though the orders from concerned departments ( DOP & DOT) in support of the above option are very clear, the accounts sections in different circles of BSNL are creating confusions on some hypothetical grounds. Hence, SNEA(I) is trying to resolve the issue at the CHQ level as early as possible.

Query 200: A) Sir, This is slightly modified to my pr query. Various streams of promotions and its linked anomalies leading to court litigation and belated DPCs caused delay in promotion in DOT set up and many retired w/o promotion and even now following the same policy is a matter of concern when all Gp B officers are in BSNL it is the need of the hour to scrap all the pretty old and protracted DOT promotion policies . What is the need of a DPC now ? (It is the DOT affair). TBP with due weightage for incumbents in DOT prior to 10/2k if achieved all will be benefited. JTO being the entry level cadre only that recruitment rule is required. In all PSU/PSEs there is TBP for certain levels. Eg in Neyveli Lignite Corpn , the cadre of Asst Manager is in 9850 scale equal to a BSNL JTO, next is Dy Manager with 10750 scale , next is Manager with 13700 scale. Can we expect such designations ? Query 198: a) Respected Sir, I had qualified for 25% quota TES Grp B. My Training period was not included while determining my Eligibility for above examination. I represented to my parent circle (J&K) They refused to include my training period while considering my eligibility. Then through proper channel I represented to DE (DOT) branch in Jan 04 .But till day i.e. 27/05/04 it was not corrected as it is clear from Promotion orders. My details are as under. Date of training 13-03-95 Date of appointment 03-07-95. Eligibility given 99-00. Whereas all circle have included training period towards eligibility for the above examination As it is clear from the result, JTO who were on training with me & there date of joining is also 03-07-95 have been given 98-99 eligibility. CS Replies: There is no problem whether you are absorbed as JTO or SDE w.e.f. 01/10/2000. The denial of promotion was the real problem. Though your query is not very clear, it seems you are already promoted from JTO to SDE after 01/10/2000. You should have taken up the matter of promotion immediately after June 2000. Now it is too late.

CS Replies: The officers availing this option of continuing in CDA till promotion will loose benefits on IDA pay scale for that period. Secondly, once you switch over to IDA scale from a particular date (say 01/10/2000), the future will go as usual. Expecting benefits of adopting IDA scale at every step is illogical.

If my pay is fixed on promotion as SDE in the m/o Jan2002 in the IDA scale, my basic arrives at 13675/= and i lose the amount around 55000/= as IDA arrear to the fixation in IDA scale on 01-10-2000 in substantive grade and then getting pay fixed as per FR-22 on regular promotion. Since I had already officiated as SDE in B.S.N.L. for period Oct 2000 to Jan2002 , I am now being denied the financial benefit for this period which as earlier agrred was Rs 2500/= p.m. by the association for officers working on depution in B.S.N.L.prior to absorption with B.S.N.L Management. Secondly, I f the J.T.O. who is still awaiting promotion and officiating as SDE and drawing basic as Rs. 8750/= in cda scale, If retains the CDA scale till regular promotion would have to deposit at least sr. 2,00,000/= to get the benefit of IDA scale fixation otherwise his basic would be Rs. 1000/= lesser. CS Replies: Giving option to switch over to IDA pay scale from CDA from the date of promotion after 01.10.2000 is something optional and not compulsory. One has to see the pros and cons of the option and decide of his own. There can be no contradiction.

CS Replies: The company in which you are absorbed (BSNL) will calculate and fix up your pay as per BSNL pay scale. All the ad hoc amounts received under this head w.e.f. 01/10/2000 will be adjusted from the payable arrears.

CS Replies: The plan is to cover all whose names appeared in the EL.That means a part of the EL may get promotion through upgradation and the rest through existing vacancies.

Query 171: Dear Comrade, Your reply for query no.153 is not satisfactory as from 1991 onwards the ratio of outsider against departmentally recruited JTO was not as 66.66% & 33.33%. It was recruited as 50:50 ratio (for departmental 35% qualifying + 15% competitive as per modified recruitment rule vide DOT order no.27-11/91-TE-II dtd 24/02/92. The same rule is adopted in JTOs recruitment rule in 1996 and in 1999. But it appears that the whole eligibility list which comprises the JTOs from the year 1990 up to 1997 (after 1995 for ST/SC) has prepared as 2:1 ratio. CS Replies: The modified recruitment rule for JTOs came into force since 1996 making the entry ratio 1:1. Earlier it was 2:1 only. However, if you are still not satisfied you have every right to send representation to DOT through proper channel highlighting the anomalies in the Provisional Eligibility List for necessary correction.

CS Replies: SNEA is now the one and only recognized association to represent all executives working in BSNL. Comrade, once the time bound promotion scheme is introduced the post bound promotion policy will become inoperative. The existing seniority, due to competitive exam or otherwise, at that point of time will be maintained and the next promotions will take place accordingly.

CS Replies: Eligibility list up to June 1996 year of recruitment is in the ratio of 1:2. After that it is 1:1, due to modification of JTO recruitment rule in 1996. To maintain the above ratio even a JTO of one category (E or D) with less % of marks can have position above the other category (D or E) under the same year of recruitment.

CS Replies: The promotion order of about 1000 successful JTOs is going to be issued soon. On promotion they will be treated as SDEs from the date of joining for all purposes, except seniority as replied to earlier queries in this regard.

Query 148: Dear sir ,I had posted qurey in January twice regarding the seniority of the direct recruit JTOs who had joined before the jtos of earlier recruitment year. How their seniority should be fixed? As you may aware that there is Mumbai high court judgement which prevails that those who joined the department first must be called as senior. Sequence of the seniority concept for fixing it has been given by the high court as 1.year of exam 2.date of appointment 3.if n jtos appointment date are same then 4. training center marks may apply. Query 134: Dear Sir, I am a JTO working under GMTD - Goa division.Iwas issued aminor charge sheet under rule 16 for providing a defaulter a ccb pco on 25-09-2002.On 26-12-2002, after necessary examination of my case , final orders were passed and the punishment declared that my increment be held up for 6 months without cummulative effect. HRD section refused to give the prsidential oders saying that Circle Office needs to be intimated about all Major/Minor charge sheet cases. CS Replies: The persons selected through 25% competitive quota against a particular year of vacancy (say 96-97)will be neither en bloc seniors nor en bloc juniors to those already promoted against the same year (96-97)against 75% seniority-cum-fitness quota.The persons selected through competitive exam will occupy the gradation list of TES grpB along with the others as mentioned above in the ratio of 1:3. This means after every three seniority-cum-fitness officers one competitive officer will be inserted in the gradation list in order of merit. This will definitely help the competitive passed officers in next promotions. So far as the financial benefit is concerned it is/will be from the date of actual promotion to TES Grp B.
